Terms of service

These terms are an agreement between you and Agora Ark ("we", "us"). They apply when you use the Agora Ark website, the Agora Ark app and everything you make with them (together, "the service"). By creating an account or using the service, you agree to them.

1. Who can use Agora Ark

You must be at least 18 years old and able to enter a binding contract. If you use Agora Ark for a business, you confirm you are allowed to accept these terms on its behalf.

2. Your account

You can sign up with an email address and password or with a Google account. Keep your sign-in details safe, and tell us at info@agoraark.com if you think someone else has used your account. You are responsible for what happens under your account.

We may deactivate an account that breaks these terms. A deactivated account cannot be signed into, and the brands it owns stop renewing at the end of their current period.

3. Brands and subscriptions

Each brand you create is its own subscription. The current price is $19.99 per brand per month, in US dollars and before any tax that applies, and is charged when you create the brand and then on each renewal date.

• Each subscription adds 100 credits to your wallet every month. Monthly credits expire at the brand's next renewal.
• Each brand's subscription is charged to the payment method you subscribed with. You can change it for each brand separately.
• Credits you buy are paid for at checkout, with the payment method you give there, and expire one year after the date you buy them.
• Payments are processed by our payment provider. We don't store your full card details.
• We may change prices. We will tell you at least 30 days before a change applies to your subscription.

We may put a brand under review while we look into how it is used, or suspend it if it breaks these terms. A brand under review can be read but not used to make or spend anything, and its subscription keeps renewing. A suspended brand cannot be opened, and its subscription stops renewing at the end of its current period.

4. Credits

Credits pay for the AI work the service does for you: compiling your Brief, suggesting palettes, typefaces and marks, and generating content in sessions. Before something is made, you see an estimate of its cost in credits. Monthly credits expire at the brand's next renewal, and credits you buy expire one year after you buy them. The credits closest to expiring are always spent first, which is usually your monthly credits. Credits have no cash value and can't be transferred or exchanged for money. Payments for subscriptions and credits are not refundable, except where the law requires it. See our refund policy.

5. Cancelling

You can cancel a brand's subscription at any time. It stays active until the end of the period you have paid for. After that, the brand is ended: it receives no new credits, and its Brief, sessions and assets become read-only.

We keep an ended brand's data for three months. If you resubscribe within that time, everything is restored as it was. After three months, it is deleted.

6. Your content

You keep ownership of what you put into Agora Ark: your answers, your Brief, the files you upload and the requests you make ("your inputs"). You give us permission to store and process your inputs only to run and improve the service for you.

Subject to these terms and to the terms of the AI providers we use, the content generated for you is yours as between you and us, and you can use it commercially. Laws on who can own AI-generated content differ from place to place, so we can't promise it is protected by copyright everywhere. You are responsible for how you use what you make, including checking that it is accurate and doesn't infringe anyone else's rights before you publish it.

7. AI output

Agora Ark uses AI models to write, draw and animate. AI output can be wrong, incomplete or similar to content made for others. Review everything before you rely on it or publish it. We don't guarantee any particular marketing result.

8. Acceptable use

Don't use Agora Ark to:

• break the law or encourage others to;
• make content that is hateful, harassing, sexually explicit involving minors, or that promotes violence;
• deceive people, impersonate others, or make misleading claims about products or services;
• infringe anyone's intellectual property, privacy or other rights;
• try to break, overload, reverse engineer or get around the limits of the service.

We may refuse a request, remove content, suspend a brand or deactivate an account that breaks these rules.

9. Our service

The Agora Ark name, logo, software and website belong to us. We may change, add or remove features, and we will try to give notice of changes that significantly affect you.

The service relies on third parties, including our hosting, database, payment and AI providers. Their availability is outside our full control.

10. Disclaimers and liability

The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties not written in these terms.

To the extent the law allows, our total liability to you for any claim about the service is limited to the amount you paid us in the 12 months before the claim arose, and we are not liable for indirect or consequential losses such as lost profits or lost data. Nothing in these terms limits liability that can't be limited by law.

11. Ending your account

You can delete your account at any time from your profile. This deletes every brand you own, with its Brief, sessions and assets, and stops each brand's subscription from renewing, so you won't be charged again. The rest of a paid period and any credits left in your wallet are not refunded. Records of your payments are kept, as our privacy policy describes.

If a brand you own is under review or suspended, or your account has been deactivated, write to info@agoraark.com to close your account. We may deactivate an account that seriously or repeatedly breaks these terms.

12. Changes to these terms

We may update these terms. If a change is significant, we will tell you by email or in the app before it takes effect. Continuing to use Agora Ark after that means you accept the new terms.

13. Governing law

These terms are governed by the laws of Thailand, and disputes will be handled by the courts of Thailand, unless the law where you live says otherwise.
